Marriage in Poland

The Verdict: Unlikely

Polish law on same-sex marriage is unsettled, so this route is a long shot for now. First establish whether your Polish spouse has lived in another EU country, because that is where your claim is strongest.

The marriage route requires a marriage to a Polish citizen, and article 18 of the Constitution defines marriage as a union of a woman and a man.

In November 2025 the Court of Justice of the EU held that Poland must recognise a same-sex marriage from another member state for EU-law purposes. The Supreme Administrative Court followed in March 2026 and the first transcription was made in May 2026. In July 2026 the President vetoed a partnership bill, and the Constitutional Tribunal held the transcription regulation unconstitutional, a ruling the government does not treat as binding and which was not published.

Where your spouse has exercised free movement, EU law can give you a permanent right of residence, one of the three statuses the citizenship provision accepts. Where your spouse has always lived in Poland, the claim rests on the contested domestic position alone.

The position may change before you apply. A Polish ancestor on your own side opens the ancestry and diaspora routes, which none of this affects.
