The Verdict: Clear Path
You can apply for permanent residence as a spouse now. Gather your marriage or partnership record and evidence that the relationship is genuine, and apply to Home Affairs.
Permanent residence is available to someone who has been the spouse of a citizen or permanent resident for five years, where the department accepts the relationship is in good faith. Civil and customary marriages, civil unions and registered permanent partnerships all count.
The permit lapses if the relationship ends within two years of issue, unless your spouse dies, and you will be interviewed in the last six months of that second year. It can also be withdrawn after more than three years' absence.
Citizenship is a later, separate application: five years' ordinary residence after permanent residence through the ordinary route, with no year over 90 days abroad. The route written for spouses needs ten.
