This is about the day you were born, not about now and not about whether they were born in Spain. Spanish nationality passes to a child whose parent held it at that moment. A parent who was Spanish earlier and lost it, or who became Spanish afterwards, is a different case with a different answer — so the date they held it matters more than the fact that they held it. Spanish nationality could be lost by taking another one, which is why this catches out families who emigrated and naturalised elsewhere.
