There is something live that may apply to you, and we want to be careful to describe it accurately, because a great deal of inaccurate material circulates on this.
A bill is before the Spanish Parliament that would grant Spanish nationality by royal decree to people born in Western Sahara while it was under Spanish administration, before 29 September 1977, without requiring them to live in Spain — and would additionally put Sahrawis and their descendants on a two-year residence route rather than ten. Reporting suggests it could reach around 80,000 people. It passed the Congress of Deputies in September 2026 and has gone to the Senate.
It is not law. It has not completed its passage, and if it does, it would come into force four months after publication. We cannot tell you it will pass, and nobody honestly can.
The reason a specific Act is needed is worth knowing. The Spanish Supreme Court has held twice that being born in the former Spanish Sahara is not the same as being born in Spain — those territories were Spanish territory but never national territory. So the ordinary descent and birth routes do not reach people in your position, and no amount of documentation changes that under current law.
What is worth doing now is gathering documentation of your birth there and of your family's connection to the territory, so that you are ready rather than starting from nothing if the bill passes. We will be watching its progress.
