1. Service description
Second Pass provides a software platform that helps individuals assess their eligibility for second citizenship through descent, naturalization, marriage, registration, and investment pathways (“the Service”). We also help manage the document collection and application process for clients who engage us directly.
2. Not legal advice
Second Pass is an information and case management tool, not a law firm. Nothing on our platform or in our communications constitutes legal advice, legal counsel, or the formation of an attorney-client relationship. Eligibility assessments are based on publicly available information and are provided for informational purposes only.
Citizenship and immigration matters are complex and jurisdiction-specific. You should consult a qualified immigration attorney or legal professional before making any decisions based on information provided by Second Pass.
3. Account responsibility
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must:
- Provide accurate and truthful information in all forms and document uploads.
- Promptly notify us at ben@secondpass.co if you suspect unauthorized access to your account.
- Not share your account credentials with others or allow third parties to access your account.
4. Acceptable use
You agree not to:
- Submit false, misleading, or fraudulent documents or information.
- Use the Service for any purpose that violates applicable law or regulation, including immigration fraud or identity fraud.
- Attempt to gain unauthorized access to any part of the platform or its underlying infrastructure.
- Scrape, reverse engineer, or reproduce the Service’s eligibility logic, question trees, or proprietary content without written permission.
- Interfere with or disrupt the Service or servers connected to the Service.
5. Limitation of liability
To the maximum extent permitted by applicable law, Second Pass and its employees shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of opportunity, arising out of or in connection with your use of the Service.
Our total aggregate liability to you for any claim arising from these Terms or the Service shall not exceed the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) USD $100.
We make no warranties, express or implied, that the Service will be uninterrupted, error-free, or that eligibility assessments will result in a successful citizenship application.
6. Intellectual property
All content, software, question trees, eligibility logic, and materials provided through the Service are the intellectual property of Second Pass or its licensors. You may not copy, distribute, or create derivative works without our written consent.
You retain ownership of documents and data you upload to the Service. By uploading, you grant us a limited license to store and process that data solely to provide the Service to you.
7. Termination
You may terminate your account at any time by using the “Delete Account” feature in Account Settings. This will permanently delete your data in accordance with our Privacy Policy.
We may suspend or terminate your access if you violate these Terms, with or without notice. In the event of termination by us without cause, we will provide a reasonable opportunity to export your data.
8. Governing law
These Terms are governed by the laws of [State/jurisdiction], without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of [State/jurisdiction], and you consent to the personal jurisdiction of such courts.
9. Changes to these terms
